1. Acceptance of Terms

These Terms of Service apply to AnchorMind and AnchorBuddy, both operated by Anchor Wellness LLC ("Anchor Wellness," "we," "our," or "us"). By accessing or using either product, our related websites, or connected features (collectively, the "Services"), you agree to these Terms. If you do not agree, do not use the Services.

2. Description of the Services

AnchorMind is a digital mental wellness platform that may include AI companions, mood tracking, meditation, journaling, goals, wellness planning, and self-reflection tools. AnchorBuddy is a proactive AI wellness companion designed to support routines, habits, mood awareness, reminders, user-directed memory, and everyday check-ins.

Features may differ by product, device, subscription level, region, and development stage. Some AnchorBuddy integrations, including HealthKit, calendar, email, push notifications, SMS, or other connected services, may be introduced or changed over time and require separate user authorization before use.

3. AI and Wellness Disclaimer

ANCHORMIND AND ANCHORBUDDY ARE WELLNESS AND INFORMATIONAL SERVICES. AI FEATURES ARE NOT PROFESSIONAL OR MEDICAL ADVICE.

  • AI companions are not licensed clinicians, psychologists, psychiatrists, physicians, counselors, or healthcare providers.
  • The Services do not diagnose, treat, cure, or prevent medical or mental-health conditions.
  • The Services are not therapy, crisis intervention, emergency care, or a replacement for licensed professional services.
  • AI-generated content may be inaccurate, incomplete, or inappropriate for your circumstances. You are responsible for how you use or rely on it.

If you believe you are experiencing an emergency or immediate risk of harm, use appropriate local emergency or crisis resources rather than relying on the Services.

4. Accounts and Eligibility

You must meet the minimum age requirements stated for the applicable product and platform. Where parental or guardian consent is required by law or platform rules, you may use the Services only with that consent. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

5. Proactive Check-ins, Notifications, and SMS

AnchorBuddy may offer optional proactive check-ins through in-app messages, push notifications, SMS, or other channels. These features are user-controlled and may require separate device, carrier, or account permissions.

  • You are responsible for enabling or disabling proactive features and managing notification or quiet-hour settings available to you.
  • If you opt into SMS, standard message and data rates may apply. You may opt out using the method provided in the message or product settings.
  • Notifications and messages are not guaranteed to arrive at a particular time and should not be relied upon for emergencies, medication management, clinical monitoring, or other time-critical purposes.

6. Connected Services and Permissions

Some features may allow you to connect third-party services or device data, such as Google Calendar, supported email accounts, HealthKit, or other integrations. You choose whether to make a connection and which permissions to grant.

  • We will request only permissions associated with the feature being offered.
  • You may disconnect supported integrations or revoke permissions through the applicable product, device, or third-party account settings.
  • Third-party services are subject to their own terms, privacy practices, availability, and technical limitations.
  • Anchor Wellness is not responsible for outages, changes, or acts of third-party services outside our control.

7. AI Memory and Personalization

Where memory or personalization features are available, the Services may retain user-directed context to make future interactions more relevant. You are responsible for the information you choose to provide. Available controls may allow you to review, change, disable, or delete remembered information. Memory and personalization do not mean that the Services continuously monitor you or independently know your emotional or medical condition.

8. Subscriptions and Payments

  • Paid features may be offered through recurring subscriptions or other purchases.
  • Subscriptions may auto-renew unless cancelled according to the rules of the applicable billing platform.
  • Prices and available features may change subject to applicable notice requirements.
  • iOS purchases are processed through Apple In-App Purchase and are subject to Apple's billing and refund rules.
  • Other purchases and refunds are governed by the applicable payment provider and our Refund Policy where applicable.

9. User Conduct

You agree not to:

  • Use the Services for unlawful, abusive, fraudulent, or harmful purposes.
  • Attempt to gain unauthorized access to accounts, systems, integrations, or data.
  • Interfere with, reverse engineer, scrape, overload, or disrupt the Services except where such restriction is prohibited by law.
  • Use connected services or messaging features to harass, threaten, impersonate, spam, or violate another person's rights.

10. Privacy

Our Privacy Policy explains how Anchor Wellness collects, uses, and protects information across AnchorMind and AnchorBuddy. Additional privacy disclosures or permission prompts may apply to specific integrations or platform features.

11. Intellectual Property

Anchor Wellness LLC owns or licenses the Services, software, branding, designs, and other protected materials associated with AnchorMind and AnchorBuddy, except for content owned by users or third parties. You retain ownership of content you create, subject to the rights reasonably necessary for us to operate the Services you request.

12. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT AI OUTPUT, NOTIFICATIONS, INTEGRATIONS, OR OTHER FEATURES WILL ALWAYS BE ACCURATE, AVAILABLE, TIMELY, COMPLETE, OR SUITABLE FOR YOUR NEEDS.

To the maximum extent permitted by applicable law, Anchor Wellness LLC and its affiliates, contractors, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services. Where liability cannot lawfully be excluded, any limitation will apply only to the extent permitted by law.

13. Community Features

Where a product offers community or user-generated-content features, users must not post or encourage harassment, threats, hate speech, discrimination, sexual exploitation, explicit sexual material, graphic violence, illegal activity, spam, impersonation, disclosure of private information, or encouragement of self-harm or harm to others. Anchor Wellness may moderate, remove content, restrict features, or suspend accounts to protect users and the Services.

14. Suspension and Termination

We may suspend or terminate access for violations of these Terms, abuse, security risks, legal requirements, or conduct that threatens users or the Services. You may stop using the Services or close your account through available account settings or support channels.

15. Changes to the Services or Terms

We may modify features, integrations, pricing, or these Terms as our products develop. Material changes may be communicated through the applicable app, website, email, or another appropriate method. Continued use after updated Terms become effective constitutes acceptance where permitted by law.

16. Governing Law and Disputes

These Terms are governed by applicable law. Any dispute-resolution, arbitration, venue, or waiver provision will apply only to the extent valid and enforceable under the law that governs the particular dispute. Nothing in these Terms eliminates rights that cannot legally be waived.
